Terms of Service

By creating an account or using BreakPanel, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the service.

BreakPanel is a tool for creating customizable team board overlays and related on-stream graphics for live trading-card breaks and similar formats, plus a free public checklist library. It's designed to be used alongside broadcasting software like OBS and live-selling platforms like Whatnot, but BreakPanel is an independent product — it is not affiliated with, endorsed by, or operated by Whatnot Inc. or any other platform you choose to stream on.

You need an account to create and run boards. You're responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information and be legally able to enter into these terms.

Creating and running boards requires an active paid membership; the checklist library remains free without one. Subscriptions are billed and managed through Stripe. You can view your plan, update payment details, or cancel at any time from the Billing page — cancellation takes effect according to the terms shown there at checkout/in the billing portal. We don't store your full payment card details ourselves.

You keep ownership of everything you upload or create — board names, rosters, images, logos, hit sounds, and similar content ("your content"). By uploading it, you grant us a limited license to host, store, and display it back to you and to your stream's viewers, solely to provide the service. You're responsible for having the rights to anything you upload, including that you have permission to use any logos, images, or sounds you add to a board.

Whatnot Sync is an optional, experimental browser extension that watches your own logged-in Whatnot seller dashboard tab in your browser and reports detected sales back to your BreakPanel board. It is explicitly a prototype: its page-detection logic hasn't been fully calibrated, and it may miss or misreport sales.

Important: platforms you stream or sell on (including Whatnot) have their own Terms of Service, which may restrict or prohibit automated use of their site or app — this can include browser extensions like Whatnot Sync that read data from a logged-in dashboard page. Using Whatnot Sync (or any similar tool) is entirely optional and entirely at your own risk and discretion. You are responsible for reviewing and complying with the terms of service of any platform you use alongside BreakPanel; we do not review those terms on your behalf and are not responsible for any consequences — including account restrictions on a third-party platform — that result from your use of Whatnot Sync or any other integration.

You agree not to:

• Use BreakPanel for anything illegal, fraudulent, or infringing on someone else's rights
• Upload content you don't have the rights to use
• Attempt to disrupt, overload, or gain unauthorized access to BreakPanel's systems or other users' accounts
• Resell, sublicense, or provide the service to others outside your own account without our agreement
• Use BreakPanel to harass, deceive, or harm buyers, viewers, or anyone else

You can stop using BreakPanel and cancel your subscription at any time. We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose a security risk to the service or other users. If we terminate your account for cause, you may not be entitled to a refund of any prepaid fees.

BreakPanel is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the service will be uninterrupted, error-free, or compatible with every streaming setup, browser, or third-party platform — including changes those platforms make to their own sites that could affect features like Whatnot Sync without notice.

To the fullest extent permitted by law, BreakPanel and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service — including lost sales, lost data, or any action taken against your account on a third-party platform. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

We may update BreakPanel's features and these Terms of Service over time. We'll update the "Last updated" date above when we do; continuing to use BreakPanel after a change means you accept the updated terms.

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law principles.
